Terms and Conditions
1. About us
This website is operated by Luxe and Beau Designs (ABN 84 652 695 362), of 2/88 Newcastle Street, Fyshwick ACT 2609, Australia. In these terms, "we", "us" and "our" mean Luxe and Beau Designs, and "you" means the person placing an order or using this website.

2. These terms
By placing an order with us you accept these terms. Please read them before you order.
We may update these terms from time to time. The terms that apply to your order are the ones published on this website at the time you place it. Changes we make later will not affect orders already placed.
3. Change of mind returns
Full priced items may be returned for a refund or exchange within 14 days of delivery, provided they are unused, in original condition, and with all tags and packaging intact. Using a discount code does not make an item a sale item.
Items purchased during a sitewide sale may be exchanged within 14 days on the same conditions, but are not eligible for a refund. Items marked Final Sale may not be returned or exchanged.
All returns must be lodged through our Returns Portal and approved before you send anything back. Items sent back without an approved return will not be accepted and may be returned to you at your cost.
Return postage is at your cost. Original shipping charges are not refunded on change of mind returns.
Returned items are inspected on arrival. Items that show signs of use, washing, wear, pet hair, smoke, fragrance or makeup marks, or that are returned without their original tags or packaging, do not qualify. Where an item does not qualify we will contact you and return it to you at your cost.
These items are also not eligible for change of mind returns: items purchased from our Warehouse Sale, personalised or custom made items, and cushion inserts where the packaging has been opened, for hygiene reasons.
This is our change of mind policy and it is separate from the rights described in section 9, which continue to apply to faulty items regardless of any time limit above.
4. Ordering
Placing an order is an offer to buy. Your order is accepted when we send you a confirmation email. If we cannot accept your order, for example because an item has sold out or we cannot verify your details, we will tell you and refund any payment in full.
We may decline, limit or cancel any order where an item is unavailable, where there has been a pricing or description error, where quantities suggest purchase for resale, where the billing and delivery details cannot be reconciled, or where we reasonably suspect fraudulent or unauthorised use of a payment method. We may contact you to verify your identity or payment details before dispatch. If we cancel after payment, we refund in full to the original payment method.
5. Prices and GST
All prices are in Australian dollars and include GST unless stated otherwise. The price you pay is the price shown at the time you place your order. We may change prices at any time, but a change will never affect an order already placed.
Prices for orders shipped outside Australia may exclude GST. Any import duties or taxes charged on arrival in the destination country are your responsibility.
Discount codes, promotional offers and gift with purchase offers are for personal use, are limited to one per order unless stated otherwise, cannot be applied retrospectively, and may not be resold or shared publicly. We may cancel an order or withdraw a discount where a code has been obtained or used in a way it was not intended.
6. Payment
We accept the payment methods shown at checkout. We do not add a surcharge to any payment method.
Title to goods passes to you when we receive payment in full. Risk passes to you on delivery.
If a payment is reversed, charged back or disputed after your order has been dispatched, we may suspend your account and recover the value of the goods and any associated fees. Where you believe a charge is incorrect, please contact us first so we can resolve it directly.
7. Delivery
Our shipping rates, dispatch times and delivery estimates are set out on our Shipping and Delivery page and form part of these terms.
Delivery timeframes are estimates provided by our carriers, not guarantees. If your order is time sensitive, please allow extra time or contact us before ordering.
Please check your delivery address carefully. If a parcel is returned to us because the address was incorrect or delivery was refused, we will resend it once you pay the cost of reshipping, or refund you less our reasonable original delivery costs.
Parcels marked as delivered. Where you select authority to leave, or your carrier account instructs delivery without signature, the parcel is left at your risk once delivered to the address you supplied. If a parcel is marked as delivered by the carrier but you have not received it, contact us within 7 days of the delivery date and we will investigate with the carrier. We may ask you to check with others at the address and with neighbours, and for higher value orders we may ask you to provide a written statement confirming non receipt before we send a replacement. Where carrier records including tracking, scan data, geolocation or a photograph indicate the parcel was delivered to the correct address, we may decline to provide a replacement or refund.
8. Pre-orders
Pre-order items are dispatched on or around the date shown on the product page. Where an order contains both in stock and pre-order items, the whole order ships together when the pre-order arrives, unless you ask us to split it. If a pre-order is delayed significantly we will contact you, and you may choose to wait or cancel that item for a full refund.
9. Your rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms limits, excludes or modifies those rights. Where any part of these terms would do so, that part does not apply.
We may ask you for proof of purchase before providing any remedy. Your order confirmation, tax invoice or bank statement showing the transaction are all acceptable.
10. Damaged or faulty items
Damage in transit
Please open and check your parcel as soon as it arrives, and tell us within 7 days of delivery if anything has arrived damaged, with photographs of the item, the damage, and the packaging it came in, including the shipping label. Prompt notice matters because it allows us to lodge a claim with the carrier, and because damage that occurred in transit is usually apparent as soon as a parcel is opened.
Where a claim is made some time after delivery, we may not be able to establish that the damage occurred before the item reached you rather than afterwards, and in that case we may not be able to provide a remedy. This is an assessment of the evidence, not a time limit on the rights described in section 9.
Please keep the item and its original packaging until your claim is resolved. Where a damaged item has been discarded, or where the packaging is unavailable, we may be unable to verify the claim with our carrier and may not be able to provide a remedy.
Faults
If an item develops a fault, email customerservice@luxeandbeau.com.au with your order number, a description of the problem, and clear photographs or video showing the issue. Please tell us as soon as you reasonably can.
Assessment
We assess every claim on its merits, and we may ask you to return the item so that it can be inspected before we decide on a remedy. Where we ask you to send an item back, we will arrange return postage or reimburse your reasonable postage cost. We may also refer the item to our manufacturer or to an independent third party for assessment. We will complete our assessment and tell you the outcome within a reasonable time, ordinarily within 10 business days of receiving the item.
The item you return must be the item supplied by us, with any tags, labels or markings intact. We may decline a claim where the item returned is not the item we supplied, where it has been altered or repaired by someone else, or where identifying tags or labels have been removed.
Where our assessment confirms a manufacturing fault, we will provide a remedy as described in section 9. For a major failure you may choose a refund or a replacement. For a failure that is not major, we may choose to repair the item, replace it, or refund it.
Where our assessment shows that the item does not have a manufacturing fault, we are not required to provide a remedy. This includes damage caused by accident, misuse, incorrect care or washing, alteration, neglect, insufficient care after delivery, or ordinary wear and tear over time. In that case we will return the item to you at your cost, or hold it for collection for 30 days, and we will explain the basis for our assessment. Where an item is not collected or return postage is not arranged within 30 days, we may dispose of it.
If you disagree with our assessment, please tell us and we will review it.
We keep records of claims made on each account, including photographs and assessment outcomes. Every claim is assessed on its own merits. Where a pattern of claims is not supported by the evidence, we may require items to be returned and inspected before any future remedy is provided, and we may decline to accept further orders.
11. Warranty on lamps
Our lamps carry a 12 month warranty from the date of purchase against manufacturing faults. Proof of purchase is required.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits given by this warranty are in addition to your other rights and remedies under the law. This warranty is given by Luxe and Beau Designs, ABN 84 652 695 362, 2/88 Newcastle Street, Fyshwick ACT 2609, email customerservice@luxeandbeau.com.au.
To claim, email us with your order number, a description of the issue, and clear photographs or video. Claims are assessed as set out in section 10. We pay the cost of assessing a valid claim, including return postage where we ask you to send the item back.
This warranty covers manufacturing faults arising under normal use. It does not cover damage from dropping or knocking the lamp over, damage caused by pets, incorrect charging, leaving the lamp permanently connected to power, damage from mishandling the bulb, dismantling the base or wiring, or ordinary wear and cosmetic ageing. It applies to the original purchaser and does not transfer on resale.
12. Handmade variation
Many of our pieces are handmade and hand finished. Small variations in shade, texture, pattern placement and finish are natural characteristics of these products rather than faults, and screens display colour differently. Significant differences from the product as described are a different matter, and section 9 applies.
13. Wholesale and trade
Wholesale and trade pricing is available at our discretion to businesses that can substantiate they operate in the design or retail trade. Wholesale accounts are subject to separate terms provided at the time your account is approved. Account login details are personal to you and must not be shared. We may withdraw access where they are misused.
Products purchased at retail prices are for personal use. They may not be resold commercially or represented as stocked by another business without our written agreement.
14. Your account
You are responsible for keeping your account details secure and for activity that occurs under your account. Please tell us promptly if you believe your account has been compromised.
We may suspend or close an account, and decline future orders, where we reasonably believe it has been used for fraudulent activity, where payment details have been used without authorisation, or where a person has been abusive to our team. Closing an account does not affect the rights described in section 9 for goods already purchased.
15. Reviews and content you post
If you submit a review, photograph or other content, you confirm it is your own, is honest, and does not infringe anyone's rights. You give us permission to display and share it in connection with our products and marketing. We may decline to publish or may remove content that is unlawful, offensive or misleading. We do not remove reviews simply because they are unfavourable.
16. Our intellectual property
This website and its contents, including our original designs, patterns, artwork, photographs and text, are owned by Luxe and Beau Designs or used under licence. You may view and download material for personal use. You may not reproduce, republish, distribute or commercially exploit any of it without our written permission.
17. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms.
18. Our liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the extent permitted by law, we are not liable for loss that was not reasonably foreseeable, and our liability for any claim relating to a product is limited, at our option, to replacing the product, repairing it, or refunding the price you paid. This limitation does not apply where the failure is a major failure, in which case the choice of remedy is yours.
19. Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier delays, natural events, and supply disruptions. If such an event affects your order we will contact you, and you may choose to wait or cancel for a refund.
20. Governing law
These terms are governed by the laws of the Australian Capital Territory, Australia. You and we submit to the non exclusive jurisdiction of the courts of that territory.
21. General
If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it.
